Homicide detectives from the State Crime Command’s Cold Case Investigation Team have today charged a man in relation to a 1987 Brisbane murder.
The man’s arrest will now trigger a legal mechanism under chapter 68 (exceptions to double jeopardy) of the Criminal Code Act 1899 whereby application will be made to the Court for an acquitted person to be retried for the offence of murder.
This is the first occasion that double jeopardy provisions have been exercised in Queensland.
There are legal restrictions preventing the publication of information identifying a person who is the subject of an application to be retried under exception to double jeopardy provisions.
Media are reminded of their obligations under Chapter 68, section 678K of the Criminal Code Act 1899.
A contravention of a prohibition on publication under this section is punishable as contempt of the Supreme Court.
As such, no further information will be released by police under any circumstances.
